Our response to the false allegations

Even though your company has delivered a top class residential community for you our discerning customer, we share your concern on the recent malicious and factually inaccurate article in the Times of India dated the 2nd of January, 2011.

However, rather than us comment on the article, we felt it would be far more appropriate to have a third party respond to these false allegations. Please find below relevant extracts from the Press Handout issued by DDA clarifying the issues raised by the newspaper.

We are confident that such an emphatic and factual representation should ease any apprehension that you may have had.
 
     
  PRESS HANDOUT (extract from Handout Issued by DDA - DATED: 06.01.2011)  
     
  CLARIFICATION  
 
1. Apropos reports in certain section of media wherein quality of construction of CWG flats has been reported selectively quoted certain observations of the third party Quality Assurance Agency viz., CBRI ignoring completely the remedial action taken on these observations which have been noted/accepted in CBRI's subsequent reports. The News Item is thus misleading and has created a completely erroneous and false impression about the quality of Games Village structure which needs to be corrected forthwith by publishing the factual position as given below.
 
     
 
2. CBRI was appointed by DDA as the third party Quality Assurance Agency in respect of Games Village to ensure its quality as per laid down standards and codes. Under the arrangement CBRI was expected to point out the deficiencies in the quality at various stages of construction so that these are brought to notice of the project developer for necessary rectification and remedial measures. The observations of CBRI as contained in their reports and remedial measures taken by the Project Developer thereon has been a continuous process.
 
 
Observations made in a particular report of CBRI were rectified and Action Taken Report (ATR) was submitted to them for their acceptance and further observations, if any, in their subsequent reports. In this entire process, spread over more than two years, (from May, 2008 to August/September, 2010) CBRI submitted a total of 13 reports. Remedial measures on the deficiencies pointed out in all these reports were taken by the Project Developer and necessary Action Taken Report (ATR) submitted to CBRI for their further comments/acceptance. The factual position in respect of Action Taken Reports and their acceptance by the CBRI in respect of observations figuring in the News Item referred above are as follows:-
 
     
  • It is true that CBRI entered the scene to test check the quality of the work on pile/foundation while the work was going on. However, the CBRI did conduct non-destructive test checks for the quality of pile/foundation work after their arrival and certified that the pile/foundation were within the acceptable norms and quality. These certifications were included in their Report No. 2. Further, in-house quality test checks were also carried out regularly by the Quality Control Laboratory set up on the site by the developer along with DDA engineers which also certified that the quality of pile/foundation were as per norms prescribed under the Bureau of Indian Standards.

  • Retrofitting of out of plumb/ tapered columns maintained in the 3rd report of CBRI was taken up by the Developer to the satisfaction of CBRI. This fact has been accepted and mentioned by the CBRI in its 5th report which is quoted as under, " Emaar MGF and ACIL have taken up the repair and retrofitting of out of plumb and prepared columns in basements of some of the towers with the guidance of CBRI".

  • To ascertain the quality of in-situ concrete, the CBRI conducted a number of Rebound Hammer and Ultrasonic Pulse Velocity Tests on the structural members like columns and beams and their result have been complied in their reports no. 5, 6 & 7, which clearly shows that the quality of concrete is good or excellent.

  • The dispute about the placement of reinforcement at the junctions of beams and columns arose due to difference of opinion between CBRI and the Designer appointed by the developer. The developer followed the design and drawings which were proof checked and certified by the IIT Roorkee.

  • Observations of CBRI contained in their 9th report relating to exposed reinforcement were attended to by taking necessary remedial measures by the Developer and the Action Taken Report submitted to CBRI. The CBRI has acknowledged this fact in their 10th report. Therefore, the building structure would have its normal life span and not the reduced span of 20 years as mentioned in the earlier report.

  • While summing up its findings, the CBRI in their last communication dated 16.08.2010 has commented as under :
 
     
  "The main purpose of addressing this mail is to bring to your kind attention about 2 unresolved issues relating to the quality of construction of Commonwealth Game Village. These issues are:  
     
  i) Leakage and Seepage in both upper and lower basements.
ii) Mock up demonstration of both active and passive fire protection system.


It may be seen from the above that all the issues raised by CBRI in their various reports except the above two were resolved to the satisfaction of CBRI.
 
     
  • The leakage and seepages could not be attended as the Games were due to be held w.e.f. 04-10-2010. However, the Developer has been directed to rectify the same which they have already started. With regard to active and passive fire protection system, it is a matter of fact that the same was tested by the fire department of GNCTD before the Games and certificate issued indicating compliance of all the provisions.
 
     
  3. The fact that the CBRI was satisfied with various remedial measures taken by the Developer of DDA on their observation in various reports can further be seen from the followings:-  
     
  • In the 7th report submitted in the month of January, 2009 by the CBRI, they have observed in para 6 of the same report, the CBRI has observed that " there is a general improvement and awareness about the quality"

  • In the 8th report of May, 2009, the CBRI has made following observations on the ATR of the 7th report " I have thoroughly gone through the Action Taken Report (ATR) submitted by the Emaar MGF on our 7th monthly report. We are satisfied with the ATR".

  • CBRI's satisfaction regarding quality of work is again reinforced and reflected from the fact that they approached DDA in November, 2010 to allot 10 flats to their parent organizations i.e. CSIR in the Games Village.
 
     
  Dear Customer, as you would know, your company had delivered the Games Village well ahead of schedule, and over 8000 athletes and officials from the Commonwealth utilized the facilities and apartments at the village and appreciated the quality of facilities and accommodation.  
     
  We would like to once again reiterate & reassure you that the construction of the Commonwealth Games Village project has not only been monitored by reputed professional organizations at every step but has also been supervised by independent experts along with DDA engineers. The project has been constructed as per the highest quality standard & specifications.Further, the plan to remedy the basement seepage will be vetted by our own reputed structural engineers, DDA's engineers and an independent panel of experts jointly nominated by DDA and Emaar MGF, and implemented.  
     
  As regards the handover of your unit, as per the contracted terms with DDA, we are awaiting a handover of units from them and will then begin refurbishing your unit, apart from giving it a fresh coat of paint to restore it to the level committed.
